Polsinelli Shughart was located in a building that could not provide expansion opportunities for the firm. With a lease expiration nearing, it was imperative that Polsinelli Shughart find a building that would offer them not only expansion capabilities, but a desirable location for their attorneys and clients, easy access in and out of Downtown Denver, and the ability to LEED certify their tenant improvements.

Consideration Analysis

Polsinelli Shughart started the process of looking for alternative locations three years prior to its existing lease expiration, when the firm was Shughart Thomson & Kilroy, P.C. The merger with Polsinelli Shalton Flanigan Suelthaus PC, crystallized the importance of flexibility in its next real estate decision. The firm was in a growth mode, looking to recruit not only lateral attorneys, but specialized practice groups. With this in mind, the firm evaluated existing buildings, buildings under construction, and proposed buildings yet under construction.


Studley (now Savills Studley) negotiated a long-term, below market transaction with a national developer (Hines), that provided Polsinelli Shughart with flexibility in determining square footage, which could range of 25,000 to 50,000 square feet. Polsinelli Shughart was not required to advise the landlord of its exact size requirement until 120 days before move-in, giving the firm plenty of time for recruiting, space planning, etc. after the execution of the new lease. For its initial premises, Polsinelli Shughart decided on 38,752 square feet, with options, followed by continuing right of first refusal, to take an additional 20,000 square feet during the term of the lease.
